Orvell Website Terms of Service

These Terms set out the rules for using the Orvell website.

§1. General provisions

1. These Terms of Service ("Terms") set out the rules for using the Orvell website (the "Service").

The Service's address will be added here once the final production domain is set.

2. The Service is presentational in nature and is primarily intended to showcase the Orvell brand, its range, and its furniture — in particular chesterfield-style furniture. The Service is not an online shop and, at this stage, does not allow purchase agreements to be concluded or purchases to be made through it.

3. Using the Service constitutes acceptance of these Terms.

4. Throughout these Terms, "Operator" means the entity identified in §11, and "User" means any person using the Service.

§2. Using the Service

1. Using the Service requires a device with internet access and a browser supporting standard web technologies (HTML5, CSS, JavaScript). Proper display of the Service may require cookies to be enabled to the extent described in the Privacy Policy.

2. The User must use the Service in a manner consistent with applicable law, these Terms, and good practice, and with respect for the rights of third parties.

3. It is prohibited to take any action that could disrupt the proper functioning of the Service or compromise its security, including in particular:

  • submitting unlawful content to the Service,
  • attempting unauthorized access to the Operator's IT systems, data, or infrastructure,
  • using automated scripts, bots, or other tools in a way that overloads or destabilizes the Service.

4. Where there is reasonable suspicion of activity inconsistent with these Terms or the law, the Operator may take measures necessary to protect the Service, including temporarily restricting access to it.

§3. Nature of the information and the offer presented

1. Photos, visualizations, descriptions, dimensions, and other product information presented in the Service are for informational and illustrative purposes only, unless expressly stated otherwise.

2. Due to individual display settings of devices (e.g. a monitor or phone screen), actual colors, shades, and material textures may differ slightly from those shown in the Service.

3. Presenting a product in the Service does not constitute an offer within the meaning of Article 66 of the Polish Civil Code, but an invitation to conclude an agreement (a request for an offer) within the meaning of Article 71 of the Polish Civil Code.

4. The Service does not currently allow placing orders or making payments online. Any arrangements regarding purchase, product availability, final price, lead time, or terms of execution are made individually, outside the Service, through direct contact with the Operator.

§4. Contact

1. Orvell can only be contacted via:

  • the e-mail address shown in the Service,
  • the phone number shown in the Service.

2. The Service does not have a contact form or any other automated channel for submitting enquiries.

§5. Intellectual property

1. The Service and its content — including in particular the Orvell name and logo, the Service's layout and visual design, photographs, graphics, product descriptions, texts, and marketing materials — are legally protected, in particular under copyright and related-rights law and industrial-property law.

2. Copying, distributing, modifying, or using the Service's content for commercial purposes without the Operator's prior written consent is prohibited, except where permitted by mandatory law (e.g. personal, non-commercial use).

§6. Liability

1. The Operator takes care to keep the information presented in the Service current and accurate, but does not guarantee it is fully complete or that the Service is available without interruption.

2. The Operator is not liable for temporary unavailability of the Service resulting from technical causes, including maintenance work, internet connectivity failures, force majeure, or circumstances beyond the Operator's control.

3. No provision of these Terms excludes or limits consumer rights arising from mandatory provisions of law, in particular the Polish Act of 30 May 2014 on Consumer Rights and the Civil Code. Where a provision of these Terms conflicts with such a provision, the provision of law prevails.

§7. Personal data

1. The rules for processing Users' personal data are described in a separate document — the Orvell Privacy Policy.

2. Personal data may be processed in particular in connection with phone or e-mail contact initiated by the User, to the extent and on the terms described in the Privacy Policy.

§8. Cookies

1. The Service uses cookies only to the extent necessary for it to function properly (including logging into the admin panel). To count visits, the Service additionally uses an analytics tool that does not use cookies. A detailed description is provided in the Privacy Policy.

§9. Changes to these Terms

1. The Operator reserves the right to amend these Terms, in particular where the Service's functionality changes (e.g. online sales are launched), applicable law changes, or the Operator's organization changes.

2. Amended Terms take effect on the date they are published in the Service, unless another date is indicated.

3. The current version of these Terms is always available in the Service, at this address.

§10. Governing law

1. These Terms and the use of the Service are governed by Polish law.

2. Matters not regulated by these Terms are governed in particular by the Polish Civil Code and — to the extent the User is a consumer — the Act of 30 May 2014 on Consumer Rights.

§11. Operator details

The Operator of the Service is a natural person selling under the Orvell brand within the scope of "działalność nierejestrowana" (unregistered small-scale activity) within the meaning of Art. 5 of the Polish Act of 6 March 2018 – Law on Entrepreneurs. The Operator can be contacted via the contact details shown in §4.

Unregistered small-scale activity is not entered in the CEIDG register and does not carry its own tax (NIP) or statistical (REGON) business number — which is why those details are not published here at this time. Full identifying details (legal name, address, NIP, REGON) will be published if the activity is formally registered as the Service grows. This does not constitute legal advice.
